一、化粧品衛生管理條例第 24 條第 2項規定：「化粧品之廠商登載或宣播廣告時，應於
事前將所有文字、畫面或言詞，申請中央或直轄市衛生主管機關核准，並向傳播機
構繳驗核准之證明文件。」同條例第 30 條第 1項規定：「違反第 24 條……第 2項規
定者，處新臺幣 5萬元以下罰鍰；情節重大或再次違反者，並得由原發證照機關廢
止其有關營業或設廠之許可證照。」（併稱系爭規定）
請問：前述系爭規定涉及何種憲法基本權利之限制？該限制是否合憲？（25 分）
二、請問：司法院就人民聲請解釋憲法，宣告聲請人據以聲請之確定終局裁判所適用之
法令，於一定期限後失效者，各該解釋之聲請人是否均得就其原因案件據以請求再
審或其他救濟？檢察總長是否亦得據以提起非常上訴？（25 分）

Any activity that has the potential to cause harm is subject to ethical considerations and
cyber warfare is no exception. Responsible practitioners of cyber warfare wish to act in an
ethical manner, just as they do in traditional, kinetic warfare. They are able to concretely
identify cyber activities that violate ethical guidelines on the international stage and hold
perpetrators legally responsible .
