一、依據工會相關法令規定，結合同一廠場之勞工得組成廠場企業工會，且
各企業工會以組織一個為限。依據憲法與憲法法庭判決，請附理由說明
下列工會法施行細則第 2條規定有無違反法律保留原則與比例原則。

工會法第 1條：「為促進勞工團結，提升勞工地位及改善勞工生活，特制定本法。」
工會法第 6條第 1項第 1款：「企業工會：結合同一廠場、同一事業單位、依公司
法所定具有控制與從屬關係之企業，或依金融控股公司法所定金融控股公司與子
公司內之勞工，所組織之工會。」
工會法第 9條：「依本法第六條第一項所組織之各企業工會，以組織一個為限。」
工會法第 48 條：「本法施行細則，由中央主管機關定之。」
工會法施行細則第 2條：「（第 1項）本法第六條第一項第一款所稱廠場，指有獨
立人事、預算及會計，並得依法辦理工廠登記、公司登記、營業登記或商業登記之
工作場所。」「（第 2項）前項所定有獨立人事、預算及會計，應符合下列要件：
一、對於工作場所勞工具有人事進用或解職決定權。二、編列及執行預算。三、單
獨設立會計單位，並有設帳計算盈虧損。」
二、甲律師事務所曾受乙公司委任處理回覆金融監督管理委員會關於資產
減損報告事件，後乙公司內部人員涉嫌違反證券交易法內線交易遭檢調
調查。檢察官聲請 A地方法院核發搜索票以搜索甲律師事務所，法院准
其聲請。檢察官搜索後扣押甲所持有與乙公司內部人員通訊往來之文書
與電磁紀錄。甲律師事務所對 A法院所核發之搜索票不服，提起抗告後
經B高等法院以抗告無理由駁回確定。
請從憲法規定與憲法法庭見解，附理由說明搜索律師事務所之下列法律
規定有無牴觸憲法。（25 分）

第122 條第 2項規定：「對於第三人之身體、物件、電磁紀錄及住宅或其他處所，
以有相當理由可信為……應扣押之物或電磁紀錄存在時為限，得搜索之。」

蹤騷擾行為），介入家庭糾紛或法律行動。這些案件一般是經由受害人、
利害關係人或相關非政府組織通報警方。

Immigration policies generally respond to labor market needs and
demographic objectives of destination countries. Governments implement
immigration policies through laws, regulations and program measures with
the objective to manage the volume, origin, direction and composition of
migration flows. In many countries, mostly in more developed regions,
migration legislations have been characterized by regularization of flows and
measures to better integrate immigrants in the host societies. In some cases,
regional agreements have influenced the legislations of the countries involved.

“With the global labor market battle underway, the days when Taiwan could
bring in large numbers of migrant workers are numbered. At the same time,
the emergence of the poaching of workers as the ‘new normal’ indicates that
treating migrant workers as cheap labor is no longer viable. Taiwan is entering
the ranks of developed countries, and the answer to its labor bottleneck may
be to turn migrant workers into immigrants.”
