一、土地法第 219 條第 1項規定，私有土地經徵收後，若有以下情形之一者，
原土地所有權人得於徵收補償發給完竣屆滿一年之次日起五年內，向該管

二、根據司法院大法官相關解釋之意旨，關於人身自由之保障，針對傳染病
防治法之「強制隔離」與入出國移民法之外國人受驅逐前由內政部移民
署為「暫時收容」之解釋，有何異同之處？外國人受驅逐前由內政部移
民署為暫時收容，未有即時司法救濟，以及逾越暫時收容期間之收容，
非由法院審查決定，應屬違憲之理由為何？（25 分）
